    SUBJECT: FINAL READING OF ORDINANCE NO. 2002-O-004
    Amending Ordinance No. 2000-O-306, authorizing the issuance of a Special Use Permit for mini-storage warehouses on Lots 7, 8, 9, and 10, Block 431, Eastern Division, located at 202 W. Saunders St., such that the permit includes a revised site plan. ZC-82-2001

    Prior action: Ordinance No. 2000-O-306, approved on December 4, 2000, authorized the issuance of a Special Use Permit for a mini-storage warehouse at this location. On October 22, 2001, this item was introduced and tabled, time uncertain, pending the completion of the site's landscaping. This item was again introduced by Eliseo Valdez, Jr. at the City Council meeting of 12/17/01.
    BACKGROUND
    Council District: V - Eliseo Valdez, Jr.
    Proposed use: Mini-storage warehouses
    Site: The site is currently occupied by Try Auto Paints and Mini-storage Warehouse. The current zoning for this site is B-3 (Community Business District) with a Special Use Permit for a mini-storage warehouse.
    Surrounding land uses: West and east of this site are different type of commercial activities. West and adjacent to this property is a restaurant. Further west is a radiator shop, a child care, auto paint shop and a couple of used car sale lots. East of this site is a car wash, the L.I.S.D. food preparation facility, and more used car sale lots. South and across Saunders St. is Cruz Baseball Field. North of this site is a mix of single family residences, apartments, and mobile homes.
    Comprehensive Plan: The Future Land Use Map identifies this area as Retail/Office.
    Transportation Plan: The Long Range Thoroughfare Plan recognizes Saunders St. as Truck Route and a Modified Major Arterial.
    Letters sent to surrounding property owners: 16 In Favor: 0 Opposed: 1
    STAFF COMMENTS
    The applicant seeks to amend the site plan originally approved by Council in 2000. The proposed site plan amendment will facilitate the construction of an interior off loading garage area to the right rear of the facility. Staff will support the proposed change only if the dimensions of the concrete drive and the garage entrance, as identified by the revised site plan to the right rear of the building, shall not exceed a combined width of 30 feet.
    A Special Use Permit is used for those type uses that warrant individual attention on a case by case basis and should not be categorized into a specific zoning district. A Special Use Permit is basically an overlay on top of the existing zoning designation and can be limited in many respects such as time, fencing, setbacks, landscaping, etc.
    P&Z COMMISSION RECOMMENDATION:
    The P & Z Commission, in a 5 to 0 vote, recommended approval of the permit amendment.
    STAFF RECOMMENDATION:
    Staff supports the proposed Special Use Permit amendment if the above condition is met.

    IMPACT ANALYSIS
    Is this change contrary to the established land use pattern?
    The established land use pattern on the Comprehensive Plan recognizes this area as Warehouse/Light Industrial. The adjacent areas are mostly vacant land.
    Would this change create an isolated zoning district unrelated to surrounding districts?
    No, the Future Land Use Map recognizes this area to be Warehouse/Light Manufacturing.
    Will change adversely influence living conditions in the neighborhood?
    No, with the exception of the Post Office the area surrounding to this site is mostly vacant land.
    Are there substantial reasons why the property can not be used in accord with existing zoning? No, the property can used with its existing zoning but a SUP is needed to allow the use of mini storage warehouses in a B-3 zoning designation.

CITY OF LAREDO ORDINANCE NO. 2002-O-004

WHEREAS, the applicant has requested that Ordinance No. 2000-O-306, authorizing the issuance of a Special Use Permit for mini-storage warehouses on Lots 7, 8, 9, and 10, Block 431, Eastern Division, located at 202 W. Saunders St., be amended such that the permit includes a revised site plan; and,

WHEREAS, the required written notices were sent to surrounding property owners at least ten (10) days before the public hearing held before the Planning and Zoning Commission on September 20, 2001; and,

WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommended approval of the proposed Special Use Permit amendment; and,

WHEREAS, notice of the amendment request was advertised in the newspaper at least fifteen (15) days prior to the public hearing held before the City of Laredo City Council on this matter; and,

WHEREAS, the City Council has held a public hearing on December 17, 2001, on the request and finds the proposed amendment appropriate and consistent with the General Plan of the City of Laredo.

WHEREAS, all conditions imposed by the Special Use Permit shall be met before the activity sanctioned by the Special Use Permit may commence.

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

Section 1: Ordinance No. 2000-O-306, authorizing the issuance of a Special Use Permit for mini-storage warehouses on Lots 7, 8, 9, and 10, Block 431, Eastern Division, located at 202 W. Saunders Street, be and is hereby amended to include a revised site plan.

Section 2: The Conditional Use Permit is further restricted to the following provisions herewith adopted by the City Council:

Section 3: This ordinance shall be published in a manner provided by Section 2.09 (D) of the Charter of the City of Laredo.

Section 4: This ordinance shall become effective as and from the date of publication specified in Section 3.
