SUBJECT: FINAL READING OF ORDINANCE NO.
2002-O-009 Authorizing the City Manager to execute all necessary documents to effectively convey title to the State of Texas, to the “Surface Only” of two parcels of land acquired in fee simple, as right-of-way for the Milo Interchange Project, as per Texas Transportation Commission Minute Order No. 107439 and Resolution No. 2001-R-077, as approved by the Laredo City Council; said land parcels being delineated on attached Exhibits “A” & “B”, and providing for an effective date.

BACKGROUND: On April 20, 1998, the City of Laredo passed Resolution No. 98-R-063, accepting Texas Transportation Commission Minute Order No. 107439, regarding funding for the Laredo Northwest International Bridge IV. Said Minute Order enumerated the financial and operational project responsibilities of the City of Laredo and the State of Texas as project co-participants. Construction of said international bridge included the Milo Interchange Project. One of the City’s responsibilities was to acquire all the necessary right-of-way from IH 35, West to the International Border Crossing at the Rio Grande River, a distance of approximately 2.5 miles. In order to comply with the terms and conditions of Texas Transportation Commission Minute Order No. 107439, regarding the Milo Interchange Project, it is necessary for the City of Laredo to convey the two above-referenced land parcels to the State of Texas.

ORDINANCE NO. 2002-O-009
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS TO EFFECTIVELY CONVEY TITLE TO THE STATE OF TEXAS, TO THE “SURFACE ONLY” OF TWO PARCELS OF LAND ACQUIRED IN FEE SIMPLE, AS RIGHT-OF-WAY FOR THE MILO INTERCHANGE PROJECT, AS PER TEXAS TRANSPORTATION COMMISSION MINUTE ORDER NO. 107439 AND RESOLUTION NO. 2001-R-077, AS APPROVED BY THE LAREDO CITY COUNCIL. SAID LAND PARCELS BEING DELINEATED ON ATTACHED EXHIBITS “A” & “B”, AND PROVIDING FOR AN EFFECTIVE DATE.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:
1. It hereby authorizes the City Manager to execute all necessary documents to effectively convey title to the State of Texas, to the “Surface Only” of two parcels of land acquired in fee simple, as right-of-way for the Milo Interchange Project, as per Texas Transportation Commission Minute Order No. 107439 and Resolution 2001-R-077, as approved by the Laredo City Council. Said land parcels being delineated on attached Exhibits “A” & “B”.
2. This Ordinance shall become effective upon passage thereof.
