SUBJECT:   Final Reading ordinance 2002-0-097 amending the City of Laredo’s FY 2001-2002 Full Time Equivalent  (FTE) positions by amending the budget to create .19 FTE for an additional Associate Municipal Court Judge position. Funding for this position is available in the 2001-2002 Municipal Court salary line item.

BACKGROUND: On November 19, 2001, Ordinance No. 2001-0-270, was approved appointing Alfonso H. Ornelas Jr. to a two year term as Associate Municipal Court Judge. This ordinance is to assure that the Court is adequately staffed during the presiding Judge’s or first associate judge’s absence. The present 2001-2002 Municipal Court Budget has 395 hours available for associate judge use.

FINANCIAL: This position is budgeted in the present 2001-2002 Municipal Court Regular Salary Line Item #101-1400-511-11-10.

ORDINANCE NO.  2002-0-097

 

 

AMENDING THE CITY OF LAREDO’S FY 2001-2002 FULL TIME EQUIVALENT POSITONS AND CREATING ONE ADDITIONAL ASSOCIATE MUNICIPAL COURT JUDGE POSITION. FUNDING FOR THIS POSITION IS AVAILABLE IN THE 2001-2002 MUNICIPAL COURT SALARY LINE ITEM. 

 

 

WHEREAS, the city charter requires the appointment of an associate municipal court judge to be

appointed by virtue of the creation of an ordinance; and

 

WHEREAS, a need exists for an additional associate municipal court judge to assure a judge is available to adequately staff the municipal court during normal court business hours; and

 

WHEREAS, city council finds said appointment is necessary to promote the general welfare of

the citizens of Laredo

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

LAREDO THAT:

 

SECTION 1.  The City of Laredo’s Full Time Equivalent positions in the FY 2001-2002 budget is hereby amended to create one additional Associate Municipal Court Judge position.

 

SECTION 2.  Severability

 

If any provision, section, subsection, sentence, clause or phrase of the ordinance, or the application

of the same to any person or set of circumstances is for any reason held to be unconstitutional, void

or invalid, the validity of the remaining portions of this ordinance unaffected shall remain in full

force and effect and declared to be severable for that purpose.

 

SECTION 3.  Effective Date

 

This Ordinance shall become effective upon its signature pursuant to the provisions set forth in

Section 2.09 (C) of the City Charter.
