SUBJECT:  FINAL READING OF ORDINANCE NO. 2002-O-099

Approving and authorizing the City Manager to execute a utility easement to the Texas Department of Transportation for the purpose of installing fiber optic cable to integrate the City of Laredo Traffic Management Center (TMC) to the TxDOT’s Traffic Management Center. Said proposed utility easement is located at the Laredo International Airport on land known as Lots 1,2,3 & wpt of Lot 4 being Block no. 1988 Eastern Division.

PREVIOUS ACTION:  On May 8, 2002, Ordinance was introduced by City Council, and Staff was instructed to proceed.

 

 

 

BACKGROUND:

 

The Texas Department of Transportation is requesting that it be granted an easement for the purpose of installing Fiber Optic Cable to integrate the City of Laredo Traffic Management Center with TxDOT’s Traffic Management Center.

 

The installation of the fiber optic lines along US Hwy 59 will interconnect both the City and TxDOT’s existing computerized traffic management facilities.

 

Integrating both Traffic Management Center’s Intelligent Transportation Systems (ITS) will allow for better traffic management opportunities in the City of Laredo.

COMMITTEE RECOMMENDATION:  The Airport Advisory Committee recommends approval.

STAFF RECOMMENDATION: That the City Manager be authorized to execute said utility easement to TxDOT.

 

 

 

 

ORDINANCE NO. 2002-0-099

 

 

APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A UTILITY EASEMENT TO THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE PURPOSE OF INSTALLING FIBER OPTIC CABLE TO INTEGRATE THE CITY OF LAREDO TRAFFIC MANAGEMENT CENTER TO THE TXDOT’S TRAFFIC MANAGEMENT CENTER. SAID PROPOSED UTILITY EASEMENT IS LOCATED AT THE LAREDO INTERNATIONAL AIRPORT ON LAND KNOWN AS LOTS 1,2,3 & WPT OF LOT 4 BEING BLOCK NO. 1988 EASTERN DIVISION.

 

 

                WHEREAS, the Texas Department of Transportation is requesting that it be granted an easement for the purpose of installing Fiber Optic Cable to integrate City of Laredo Traffic Management Center with TxDOT’s Traffic Management Center; and

 

                WHEREAS, integrating both Traffic Management Centers will allow for better traffic management opportunities in the City of Laredo; and

 

                WHEREAS, The Airport Director and Airport Advisory Committee recommend that this easement be granted to the Texas Department of Transportation being in the best interest of the Airport and City of Laredo; and

 

                NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

 

Section 1:               The City Council of the City of Laredo approves the granting of the utility easement and authorizes the City Manager to execute said easement to the Texas Department of Transportation; and

 

Section 2:               Said easement is described as follows;

FIELD NOTES FOR UTILITY EASEMENT

 

Being 0.055 of one acre (2,416 square feet) of land, situated in the Eastern Division of the City of Laredo, Webb County, Texas, being a part of that certain Lots 1, 2, 3 and 4, Block 1988, conveyed in deed from Jose Ricardo Benavides, and wife, Maria Guadalupe Benavides, to the City of Laredo, by deed dated July 24, 2000, as recorded in Volume 938, Page 834, Official Records of Webb County, Texas; said 0.055 of one acre of land, being particularly described by metes and bounds as follows:

 

COMMENCING at a 5/8 inch rod with a yellow plastic cap marked "RODS SURVEYING INC" set at the northwesterly corner of the Re-plat of a 6.4150 acre tract of land, recorded in Volume 3. Page 37-A, Plat Records of Webb County, Texas, and the northwest corner of that certain 0.8912 acre tract, conveyed to Ruben Garibay, d/b/a A-1 Auto Stop, by deed dated April 19, 1996, recorded in Volume 400, Page 899, Official Records of Webb County, Texas, being the northeasterly corner of that certain Block 1965-B; said Block 1965-B, being a portion of that abandoned north one-half of Saunders Street, (based on a width of 55.56 feet wide), re-plated under Volume 6, Page 88, Plat Records of Webb County, Texas, also being a re-entrant corner on the southerly line of the Laredo International Airport, from which a 5/8-inch rod found bears, South 01° 44' 50" West, a distance of 34.34 feet, thence as follows:

 

SOUTH 00° 35" 41" WEST, with the westerly line of said 0.8912 acre tract, the east line of  said Block 1965-B and the east line of said Lot 4, Block 1988, a distance of 180.27 feet to a 5/8 inch iron rod with a yellow plastic cap marked "RODS SURVEYING INC" set for the POINT OF BEGINNING, having surface coordinated of X=672,174.18 and Y=17,083,212.28.  All bearing and coordinates are based on the State Plane Coordinates System of Texas, South Zone, North American Datum 1983 (1996 adjustment), Imperial units.  All distance and coordinates are surface and may be converted to grid by dividing by a surface adjustment factor of 1.0003;

 

1.                    THENCE, SOUTH 00° 35' 41" WEST, continuing with said easterly line of said Lot 4, Block 1988, a distance of 10.10 feet to a PK nail set for corner on the existing north right of way line of U.S. 59, (based on a width of 80.00 feet);

 

2.                    THENCE, NORTH 81° 17' 19" WEST, with the said existing north right of way line of U.S. 59, a distance of 241.56 feet to a 5/8 inch iron rod with a yellow cap marked "RODS SURVEYING INC" set for the southwest corner of the herein described easement, being the southwest corner of Block 1988 and the southeast corner of that certain Lot 5, Block 1965-A, a Replat of Block 1965, as shown on map or plat hereof, recorded in Volume 6, Page 88, Plat Records of Webb County, Texas;

 

3.                   THENCE, NORTH 00° 35" 19" EAST,  with a line parallel to the easterly line of said Block 1965-A, a distance of 10.10 feet to a 5/8 inch rod, with a yellow plastic cap marked "RODS SURVEYING INC" set for corner;

 

4.                   THENCE, SOUTH 81° 17' 19" EAST, with a line parallel to and 10 feet north of the existing north right of way line of U.S. 59, a distance of 241.58 feet, to the POINT OF BEGINNING and containing 0.055 of one acre (2,416 square feet) of land.
