SUBJECT:  FINAL READING OF ORDINANCE #2002-O-116

Authorizing the City Manager to execute all necessary documents to effectively convey fee simple title to the “Surface Only”, at its combined market value of $22,241.00 for certain properties described as follows to their respective abutting property owners and providing for an effective date. 

 

Parcel  A  - consists of  8,112.59 sq. ft., more or less, to Carlos J. Vergara at the  market value of $14,524.00;  said parcel being out of Milmo Avenue between Blaine Street and the North  right-of-way line of Loop 20,  situated in the Eastern Division, City of Laredo, Webb County, Texas being described on attached Exhibit “A”; 

 

Parcel B – consists of 3,858.36 sq. ft., more or less, to the Carmen Jacaman Family Limited Partnership at the market value of  $7,717.00; said parcel being out of Milmo Avenue between Blaine Street and the North right-of-way line of Loop 20 situated in the Eastern Division, City of Laredo, Webb County, Texas being described on attached Exhibit “B”.

PREVIOUS COUNCIL ACTION:

On May 20, 2002, this Ordinance was introduced by the City Council.

 

BACKGROUND:

On February 23, 1987, the City Council passed an Ordinance, closing as a public easement, that section of Milmo Avenue between Blaine Street and the North right-of-way line of Loop 20, situated in the Eastern Division.

 

Mr. Carlos J. Vergara and the Carmen Jacaman Family Limited Partnership, the abutting property owners of the above-mentioned former street, have requested that the City of Laredo consider selling them their corresponding share of the above-mentioned former street.   Said City property has been appraised by a State Certified Real Estate Appraiser at $22,241.00.

BACKGROUND cont.

 

Parcel A  consists of  8,112.59 sq. ft., more or less,  parcel of land out of  Milmo Avenue between Blaine Street and the North right-of-way line of Loop 20 was appraised as follows:

 

The market value of the north 76.57’ x 55.56’ out of the south one-half section was established at $ 6,807.00 (4,254.22 sq. ft. @ $1.60 per sq. ft.) due to its proximity of a drainage ditch, lack of accessibility and depth. 

 

The market value of the northeast quarter (27.78’ x 138.89’) was established at $7,717.00

(3,858.36 sq. ft. @ $2.00 per sq. ft.).  Therefore, the total market value of Parcel A was established at  $14,524.00.   

 

Parcel B  – Consists of 3,858.36 sq. ft., more or less, parcel of land out of the northwest quarter of Milmo Avenue between Blaine Street and the North right-of-way line of Loop 20 was established at $ 7,717.00 (27.78’ x 138.89’= 3,858.36 sq. ft  @ $2.00 per sq. ft.

 

This property is not on the tax rolls since the City of Laredo is the owner, however, the Webb County Tax Appraisal District has properties in the area valued between $1.00 and $3.00 per square foot. Therefore, the combined market value for Parcels A & B is $22,241.00.    

 

As per Section 10 of the Street Closing/Sales Policy Handbook, approved per Resolution No.

97-R-140, requiring the submission of an Improvement Plan by the buyers is not applicable to this case because this property is zoned R-2, Multi-Family Residential District.

VERGARA, AT THE MARKET VALUE OF  $14,524.00; SAID PARCEL BEING OUT OF MILMO AVENUE BETWEEN BLAINE  STREET AND THE NORTH  RIGHT-OF-WAY LINE OF LOOP 20 SITUATED IN THE EASTERN DIVISION, CITY OF LAREDO, WEBB COUNTY, TEXAS BEING DESCRIBED ON ATTACHED EXHIBIT “A”;

 

PARCEL B - CONSISTS OF 3,858.36 SQ. FT.,  MORE OR LESS,

TO THE CARMEN JACAMAN FAMILY LIMITED PARTNERSHIP AT THE MARKET VALUE OF $7,717.00; SAID PARCEL BEING OUT OF MILMO  AVENUE BETWEEN BLAINE STREET AND THE NORTH RIGHT-OF-WAY LINE OF LOOP 20  SITUATED IN THE EASTERN DIVISION, CITY OF LAREDO, WEBB COUNTY, TEXAS BEING  DESCRIBED ON ATTACHED EXHIBIT “B”.

 

 

WHEREAS, on February 23, 1987, the City Council passed an Ordinance, closing as a public easement, that section of Milmo Avenue between

Blaine Street and the North  right-of-way line of Loop 20, situated in the Eastern Division, City of Laredo, Webb County, Texas; and,

           

            WHEREAS, by virtue of the Original Land Grant from the Crown of Spain to the City of Laredo, fee simple title to certain streets is vested in the City of

Laredo; and,

 

            WHEREAS, Carlos J. Vergara and the Carmen Jacaman Family Limited Partnership,  the abutting property owners of the above-mentioned former street, have requested that the City of Laredo consider selling them their corresponding share of that former section of Milmo  Avenue between Blaine Street and the North  right-of-way line of Loop 20; and,

 

            WHEREAS, said City property has been appraised by a State Certified Real Estate Appraiser at $22,241.00; and,

 

            WHEREAS, Carlos J. Vergara and the Carmen Jacaman Family Limited Partnership have accepted the City’s offer to purchase Parcels A & B,

respectively, out of Milmo Avenue between Blaine Street and the North right-of-way line of Loop 20 at the total combined market value of $22, 241.00; and

 

            WHEREAS, City Council finds that it is in the best interest of the City of Laredo to sell the above-mentioned Parcels A & B out of Milmo Avenue

between Blaine Street and the North  right-of-way line of Loop 20  to Carlos J. Vergara and the Carmen Jacaman Family Limited Partnership at the total

combined market value of  $22,241.00.               

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

 

1.      It hereby authorizes the City Manager to execute all necessary documents to effectively convey fee simple title to the “Surface Only”, at its combined

2.      market value of $22,241.00 for certain properties described as follows to their respective abutting property owners.

3.      This Ordinance shall become effective upon passage thereof.
