SUBJECT:  FINAL READING ORDINANCE NO. 2002-O-150

 Amending the City of Laredo Code of Ordinances, Section 13-81- Fees of Article IV. Permitting of  Food Service Operators, Chapter 13, Food and Food Products, to raise the fee of $10 to $30 for a Food Service Operator Permit; provide for publication and an effective date.

PREVIOUS COUNCIL ACTION:   On July 1, 2002, Council held public hearing introducing ordinance and instructed staff to proceed with final readings.

BACKGROUND:

 

To ensure public health, safety and disease prevention, the director of the City of Laredo Health Department  has determined that it is necessary to increase the fee for issuance of a food service operator’s permit, processing, handling applications and maintenance of food service operator’s permit records.  The Health Director deems it is necessary to increase the fee in recognition of a fair face value for food service operator permits.

FINANCIAL:    The City of Laredo will receive an estimated amount of $3,400 in additional revenues if this proposal is approved.

ORDINANCE NO. 2002-O-150

 

AMENDING SECTION 13-81. (FEES) OF ARTICLE IV. PERMITTING OF FOOD SERVICE OPERATOR OF CHAPTER 13, FOOD AND FOOD PRODUCTS, OF THE CODE OF ORDINANCES TO RAISE THE FEE TO THIRTY DOLLARS ($30.00) FOR A FOOD SERVICE OPERATOR PERMIT; AND  PROVIDING FOR PUBLICATION AND EFFECTIVE DATE.

 

WHEREAS, to ensure public health, safety and disease prevention, the director of the City of Laredo Health Department  has determined that it is necessary to increase the fee for issuance of a food service operator’s permit, processing, handling applications and maintenance of food service operator’s permit records; and

 

WHEREAS, the Health Director  has determined that it is necessary to increase the fee in recognition of a fair face value for food service operator permits; and

 

WHEREAS, a public hearing has been held as to the proposed increase in the certification fee for food service operators permits at least sixty (60) days prior to the effective date of this Ordinance in compliance with Section 6.10(B) of the City Charter; and

 

WHEREAS, after public hearing thereon, the City Council of the City of Laredo has determined that it is necessary to increase the food service operator’s permit fee to cover the increase costs of processing, handling of food service operator’s applications and maintenance of food service operator’s records and files relating to issuance of said permits.

 

NOW THEREFORE BE IT ORDANINED BY THE CITY COUNCIL OF THE CITY OF LAREDO:

 

Section 1.  Amendment.

 

                That Section 13.81of the Code of Ordinances be and is hereby amended to read as follows:

 

                (a)  Food service operator permit application fee is hereby set at[ten dollars ($10.00) ]thirty dollars ($30.00).  Such fee shall be required to be made payable to the City of Laredo at the offices of the Laredo Health Department at 2600 Cedar Avenue or renewal.

 

Section 2. Publication.

 

                This Ordinance shall be published one (1) time in a newspaper of general circulation in Laredo.

 

Section 3. Effective Date.

 

                This Ordinance shall become effective not less than sixty (60) days from the date of the public hearing on this Ordinance, in accordance with the City Charter.
