SUBJECT:  FINAL READING OF INTRODUCTION OF AN ORDINANCE NO.  2002-O-202

Establishing and adopting an Ordinance granting the City Manager authority to enter into short term (not to exceed sixty (60) days) lease agreements with interested parties for use of Airport Property and Facilities located at the Laredo International Airport and authorizing the City Manager to implement said Ordinance; providing for an effective date.

PREVIOUS ACTION:  On August 5, 2002, Ordinance was introduced by City Council, and Staff was instructed to proceed. None  

 

BACKGROUND:    In order to facilitate the leasing of property and help maximize revenues to the Airport, the following terms and conditions will be addressed in the proposed Ordinance:

 

a.  Lease term shall not exceed ninety (90) days,

b.  Rent charged shall be fair market rents,

c.  Lessee shall pay, in advance, the rent, plus deposit,  

d.  Lessee provide proof of liability insurance and naming the City of Laredo as a co-insured prior to 

     occupancy of the premises,

e.  That the Lessee agree to indemnify the City of Laredo from any liability resulting from Lessee’s use and

     occupancy of the premises,

f.  Lessee compliance with all applicable local, state and federal laws, ordinance, regulations in regards to

     the use and occupancy of the leased premises, and

g.  Any other condition, as may be deemed appropriate by the City Manager.

 

From time to time the airport receives a request to lease an airport facility for an event ranging from one day to 60 to 90 days.  The proposed ordinance would enable the City Manager to execute a short-term lease.

For example Laredo Candle Company 60-day lease, the Shriner’s Circus, etc.  The standard approval process can take anywhere from 30 to 45 days or more depending on meeting schedules for the Airport Advisory Committee and City Council.  Often times the Airport receives requests to lease airport facilities with insufficient lead time and must reject the requests.

 

 

 

 

FINANCIAL IMPACT:  The Airport Fund would derive additional revenues to Account No. 242-0000-361-1060 (Buildings) and/or Account No. 242-0000-361-2070 (Land).  Proposed rent will be based on Fair Market Rent Analysis.

COMMITTEE RECOMMENDATION: The Airport Advisory Committee recommends approval.

STAFF RECOMMENDATION:  That City Council establish and adopt an Ordinance authorizing the City Manager to enter into short term lease agreements with interested parties for use of Airport Property and Facilities.

 

 

 

 

ORDINANCE NO. 2002-O-202

 

ESTABLISHING AND ADOPTING AN ORDINACE GRANTING THE CITY MANAGER AUTHORITY TO ENTER INTO SHORT TERM (NOT TO EXCEED SIXTY (60) DAYS) LEASE AGREEMENTS WITH INTERESTED PARTIES FOR USE OF AIRPORT PROPERTY AND FACILITIES LOCATED AT THE LAREDO INTERNATIONAL AIRPORT AND AUTHORIZING THE CITY MANAGER TO IMPLEMENT SAID ORDINANCE, PROVIDING FOR EFFECTIVE DATE.

 

            WHEREAS, the Airport Director and the Airport Advisory Committee recommend that the City Council approve the proposed ordinance authorizing the City Manager to enter into short term (not to exceed sixty (60) days) lease agreements with interested parties for use of airport property and facilities located at the Laredo International Airport, in furtherance of the development of the Laredo International Airport and as a support to the maintenance and operation of the Laredo International Airport.

 

            WHEREAS, authorizing the City Manager to enter into short term (not to exceed sixty (60) days) leases with interested parties for use of airport property and facilities located at the Laredo International Airport will facilitate the leasing of property and help maximize revenues to the Airport Fund; and

 

            WHEREAS, all short term leases for airport property shall conform to the following terms and conditions.

 

a.                   Lease term shall not exceed sixty (60) days,

b.                  Rent charged shall be fair market rents,

c.                   Lessee shall pay, in advance, the rent, plus deposit,

d.                  Lessee provide proof of liability insurance and naming the City of Laredo as a co-insured prior to occupancy of the premises,

e.                   That the Lessee agree to indemnify the City of Laredo from any liability resulting from Lessee’s use and occupancy of the premises, 

f.                    Lessee compliance with all applicable local, state and federal laws, ordinances, regulations in regards to the use and occupancy of the leased premises; and

g.                   Any other condition, as may be deemed appropriate by the City Manager.

 

            WHEREAS, the City Council of the City of Laredo is of the same opinion.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

 

Section 1:         The City Manager is authorized to enter into short term (not to exceed sixty (60) days) lease agreements with interested parties for use of airport property and facilities located at the Laredo International Airport, in furtherance of the development of the Laredo International Airport as authorized by this ordinance.

 

a.         Lease term shall not exceed sixty (60) days,

c.         Lessee shall pay, in advance, the rent, plus deposit,

d.         Lessee provide proof of liability insurance and naming the City of Laredo as a co-insured prior to occupancy of the premises,

Section 2:         This Ordinance shall become effective upon the passage thereof.
