    SUBJECT: FINAL READING OF ORDINANCE NO. 2002-O-215
    Amending the Zoning Ordinance (Map) of the City of Laredo by rezoning the R-3 (Mixed Residential District) designated portion of Lot 6, Kahn Subdivision, located at 9505 Mines Road., from R-3 (Mixed Residential District) to B-3 (Community Business District); providing for publication and effective date.     BACKGROUND
    Council District: VII - Jose A. Valdez, Jr.
    Proposed use: Commercial and Residential (The applicant proposes removal of those mobile homes occupying the most western 245 feet of the property and replacing them with a retail complex, whose specific uses are as yet undetermined. The existing mobile home park, known as Monique's Mobile Home Villa shall be confined to the middle 533 feet of the lot, while the existing landscaping business located on the most eastern portion of the property shall remain as is).
    Site: Lot 6 is a large lot measuring approximately 1,326 feet in length and 267 to 153 feet in width, at it's western and eastern borders respectively. Monique's Mobile Home Villa currently occupies approximately the western 778 feet of the lot, while and approximately the rear 548 feet of the lot are occupied a landscaping business.
    Surrounding land uses: The area north of the site is vacant and undeveloped while the area to the south is occupied by a predominantly industrial uses including the Tanjore warehouse complex, the Bruni International US Custom Brokers complex, Laredo Cotton Transfer, Trans Terre Forwarding Agency, Teleflex, Vilore Foods, Alcalosa Forwarding, Alesa Forwarding, Parker and Company, Universal Truck Services, and Jerry Resendez Enterprises. East of the Site are the Mustang Industrial Equipment Company, and La Bodeguita Shipping.
    Comprehensive Plan: The Future Land Use Map recognizes this area as Warehouse/Light Industrial.
    Transportation Plan The Long Range Thoroughfare Plan identifies Mines Road. as a Truck Route and a Super Street at this location.

    STAFF COMMENTS
    The proposed zone change is appropriate at this location. The applicant intends the rezoning of this site to B-3 as a transitionary step towards the future realization of an M-1 (Light Manufacturing District) designation of this site. Although the future M-1 zoning is clearly the most appropriate designation when considering the site is almost completely surrounded by M-1 zoned area's, the requested B-3 district is the most intensive of the commercial designations which still allows mobile home parks. Since a reduced version of the existing mobile home park will remain at this site at least for the short term, it is evident that the B-3 zoning is the most suitable designation for the present time.
    P&Z COMMISSION RECOMMENDATION:
    The P & Z Commission, in a 7 to 0 vote, recommended approval of the zone change.
    STAFF RECOMMENDATION:
    Staff supports the proposed zone change.

    IMPACT ANALYSIS
    B-3 (Community Business District): The purpose of the B-3 District is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.
    Is this change contrary to the established land use pattern?
    No, the site is completely surrounded by commercial and industrial uses.
    Would this change create an isolated zoning district unrelated to surrounding districts?
    No, the adjoining zoning districts are B-3 and M-1.
    Will change adversely influence living conditions in the neighborhood?
    A reduced version of the existing mobile home park will remain, but will be moving towards eventual removal.
    Are there substantial reasons why the property can not be used in accord with existing zoning? No, but the proposed zone is more compatible with the surrounding zoning districts and land uses.

CITY OF LAREDO ORDINANCE NO. 2002-O-215

WHEREAS, a zone change has been requested by the owners of the R-3 (Mixed Residential District) designated portion of Lot 6, Kahn Subdivision, located at 9505 Mines Road., from R-3 (Mixed Residential District) to B-3 (Community Business District); and,

WHEREAS, the required written notices were sent to surrounding property owners at least ten (10) days before the public hearing held before the Planning and Zoning Commission on July 18, 2002; and,

WHEREAS, the Planning and Zoning Commission, after a public hearing, has recommended approval of the proposed zone change; and,

WHEREAS, notice of the zone change request was advertised in the newspaper at least fifteen (15) days prior to the public hearing held before the City of Laredo City Council on this matter; and,

WHEREAS, the City Council has held a public hearing on August 19, 2002, on the request and finds the zone change appropriate and consistent with the General Plan of the City of Laredo; and,

WHEREAS, the City Council does not consider the impact, if any, of private covenants and deed restrictions on the subject property with the adoption of this ordinance; and,

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

Section 1: The Zoning Map of the City of Laredo be and is hereby amended by rezoning the R-3 (Mixed Residential District) designated portion of Lot 6, Kahn Subdivision, located at 9505 Mines Road., from R-3 (Mixed Residential District) to B-3 (Community Business District).

Section 2: This ordinance shall be published in a manner provided by Section 2.09 (D) of the Charter of the City of Laredo.

Section 3: This ordinance shall become effective as and from the date of publication specified in Section 2.
