SUBJECT:  FINAL READING OF ORDINANCE #2002-O-225

Authorizing the City Manager to execute all necessary documents to effectively convey fee simple title to the “Surface Only”, at its combined adjusted market value of $4,848.00, for certain properties described as follows to their respective abutting property owners and providing for an effective date.

 

Parcel A - consisting of a 900.32 sq. ft.  parcel of  land, more or less,  to Jesus Villanueva Blanco, Petra Vega de Villanueva, Jesus Villanueva Vega and Francisco Villanueva Vega  at its total adjusted market value of  $2,094.00;  said parcel being out of that former section of Malinche Avenue between Pecan and San Salvador Streets; being described on attached Exhibit “A”;

 

Parcel B - consisting of  a 1,140.27 sq. ft. parcel of land,  more or less,  to Cesar Santos at its total adjusted market value of  $2,754.00;  said parcel being out of that former section of Malinche Avenue between Pecan and San Salvador Streets; being described on attached Exhibit “B”; 

 

said parcels being situated in the Eastern Division, City of Laredo, Webb County, Texas.

PREVIOUS COUNCIL ACTION:

On August 19, 2002, this Ordinance was introduced by the City Council.

BACKGROUND:

On May 21, 2001, the City Council passed an Ordinance No. 2001-O-100, closing as a public easement, that section of Malinche Avenue between Pecan and San Salvador Streets.

 

Jesus Villanueva Blanco, Petra Vega de Villanueva, Jesus Villanueva Vega and Francisco Villanueva Vega and Cesar Santos, abutting property owners of the above-mentioned former street, have requested that the City of Laredo consider selling them their corresponding share of the above-mentioned former street.  Their corresponding share of this former street is more generally described on the attached Exhibits “A” and “B”.

Anticipated revenue from this sale is $4,848.00 – Account No. 241-0000-374-1101.

BACKGROUND: continued

 

Based on an appraisal report on the entire former street by a State Certified Real Estate Appraiser, the market value of Parcels A and B are as follows:  $2,476.00 and $3,136.00 respectively.  For a total combined market value of $5,612.00 for the two parcels.

 

PARCEL A -  a 900.32 sq. ft. tract of land,  more or less, out of Malinche Avenue between Pecan and San Salvador Streets situated in the Eastern Division. The market value was established at

$2,476.00. However, the total market value is being adjusted downward by $382.00               (277.74 sq. ft. at $1.375 per square foot), which is 50% of the market value of the area comprised by a 6” utility easement being retained by the City.  Therefore, the adjusted market value of this tract, after deducting the 50% value of the area comprised by the easement, is $2,094.00.        

 

PARCEL B - a 1,140.27 sq. ft. tract of land, more or less, out of Malinche Avenue between Pecan and San Salvador Streets. The market value the above-mentioned property is $3,136.00 (1,140.27 sq. ft. at the market value of $2.75 per square foot).  However, the total market value is being adjusted downward by $382.00 (277.74 sq. ft. at $1.375 per square foot), which is 50% of the market value of the area comprised by a 6’ utility easement being retained by the City.  Therefore, the adjusted market value of this tract, after deducting the 50% value of the area comprised by the easement, is $2,754.00. 

 

Therefore, the combined adjusted market value for Parcel A and Parcel B is $4,848.00.  This property is not on the tax rolls since the City of Laredo is the owner, however, the Webb County Tax Appraisal District has properties in the area valued between $1.00 and $3.00 per square foot.

 

As per Section 10 of the Street Closing/Sales Policy Handbook, approved per Resolution No.

97-R-140, requiring the submission of an Improvement Plan by the buyers is not applicable to this case because the use of these properties is residential.

AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS TO EFFECTIVELY CONVEY

PARCEL B - CONSISTING OF  A 1,140.27 SQ. FT. PARCEL OF LAND,  MORE OR LESS,  TO CESAR SANTOS AT ITS TOTAL ADJUSTED MARKET VALUE OF  $2,754.00.  SAID PARCEL BEING OUT OF THAT FORMER SECTION OF MALINCHE AVENUE BETWEEN PECAN AND SAN SALVADOR STREETS; BEING DESCRIBED ON ATTACHED EXHIBIT “B”; 

 

SAID PARCELS BEING SITUATED IN THE EASTERN DIVISION,  CITY OF LAREDO, WEBB COUNTY, TEXAS.

 

 

WHEREAS, on May 21, 2001, the City Council passed Ordinance No. 2001-O-100, closing as a public easement, that section of  Malinche Avenue between Pecan and San Salvador Streets, situated in the Eastern Division, City of Laredo, Webb County, Texas; and,

           

            WHEREAS,  by virtue of the Original Land Grant from the Crown of Spain to the City of Laredo, fee simple title to certain streets is vested in the City of Laredo; and,

 

            WHEREAS, Jesus Villanueva Blanco, Petra Vega de Villanueva, Jesus Villanueva Vega and Francisco Villanueva Vega and Cesar Santos, have requested that the City of Laredo consider selling them their corresponding shares of  that former section of Malinche Avenue between Pecan and San Salvador Streets; and,

 

            WHEREAS, based on an appraisal report on the entire former street by a State Certified Real Estate Appraiser the market value of Parcels A and B are as follows:

$2,476.00 and $3,136.00 respectively for the a total combined market value of

$5,612.00; and,

 

WHEREAS, the City of Laredo will retain a 6 foot wide utility easement on the

above-mentioned properties; and,

 

WHEREAS, in compliance with the City of Laredo’s Street Closing/Sales Policy Handbook, the market value of the area comprised by the above-mentioned easement, being retained by the City, will be adjusted downward by 50%; and,

 

WHEREAS, $5,612.00, the combined market value of Parcels A and B, will be adjusted downward by $764.00, which is the 50% value of the areas comprised by the easement being retained by the City, therefore, establishing the combined adjusted market value of Parcels A and B at $4,848.00; and,     

 

WHEREAS, Jesus Villanueva Blanco, Petra Vega de Villanueva, Jesus Villanueva Vega and Francisco Villanueva Vega and Cesar Santos, abutting property owners of the above-mentioned former street, have accepted the City’s offer to purchase their corresponding respective shares as follows:

           

PARCEL A -  a 900.32 sq. ft., tract of land,  more or less, out of 

Malinche Avenue between Pecan and San Salvador Streets situated

in the Eastern Division,  at its adjusted  market value of $2,094.00.                    

                                         

PARCEL B - a 1,140.27 sq. ft., tract of land, more or less, out

of Malinche Avenue between Pecan and San Salvador Streets

situated in the Eastern Division, City of Laredo, Webb County,

at its adjusted market value of $2,754.00.

 

            WHEREAS, the City Council finds that it is in the best interest of the City of Laredo to sell the above-mentioned Parcel A to Jesus Villanueva Blanco, Petra Vega de Villanueva, Jesus Villanueva Vega and Francisco Villanueva Vega at the adjusted market value of  $2,094.00 and Parcel B to Cesar Santos at the adjusted market value of

$2,754.00.                

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

 

1.        It hereby authorizes the City Manager to execute all necessary documents to effectively convey  fee simple title to the “Surface Only”, at its total adjusted market value of $4,848.00, for certain properties described as follows to their respective abutting property owners.

 

 

       Parcel  A – consisting of a 900.32 sq. ft. parcel of land,  more or less, to

       to Jesus Villanueva Blanco, Petra Vega de Villanueva, Jesus Villanueva  

       Vega and Francisco Villanueva Vega at the total adjusted market value

       of  $2,094.00;  said parcel being out of Malinche Avenue between

       Pecan and San Salvador Streets, being described on attached Exhibit “A”          

       and

 

       Parcel B - consisting of a 1,140.27 sq. ft. parcel of land, more or less, to 

       Cesar Santos at the total adjusted market value of $2,754.00; said parcel

being out of Malinche Avenue between Pecan and San Salvador Streets,       

being described on attached Exhibit “B”.  Said parcels being situated in the

Eastern  Division, City of  Laredo, Webb  County, Texas.

 

2.                     This Ordinance shall become effective upon passage thereof.
