SUBJECT:  FINAL READING OF ORDINANCE NO. 2002-O-296

Approving the donation of an approximate 3.03 acre tract (surface only) of non-aeronautical use land located at the Laredo International Airport to the Board of Regents of the University of Texas for the public purpose of establishing and operating an extension campus of the University of Texas Health Science Center at San Antonio in accordance with section 272.001 (j) of the local government code and authorizing the City Manager to execute all necessary documents. This conveyance completes a donation of approximately 12.003 acres with a fair market value of  $2,617,000.00

PREVIOUS ACTION: On November 4, 2002, Ordinance was introduced by City Council, and Staff was instructed to proceed.

 

BACKGROUND: The University requested that the donation of the subject 3.03 acres be deferred until completion of demolition and removal of the two buildings located on the subject property.

 

On December 15, 1997, the University of Texas approached the City of Laredo requesting a site on which to establish and operate an extension campus of the University of Texas Health Science Center at San Antonio.  On October 12, 1999 the FAA approved the release of the subject property enabling the sale to the City General Fund.

 

The Honorable State Senator Judith Zaffirini and the Honorable State Representative Henry Cuellar were instrumental in the introduction and passage of state legislation enabling municipalities to donate land to institutions of higher learning and state approval establishing the Laredo campus of the University of Texas Health Science Center at San Antonio.  The State has appropriated $ 4.0 million and local contributors have pledged $3.0 million in donations to the University System to construct the first structure.

 

 

FINANCIAL: The total donation to the university totals $ 2,617,000.00, does not include cost to relocate Utilities and Public Works Departments. 

 

 

          

STAFF RECOMMENDATION:

That the City Manager be authorized to execute all necessary conveyance documents to convey the subject property to the University of Texas Board of Regents for the public purpose of establishing and operating a campus of the University of Texas Health Science Center at San Antonio.

 

ORDINANCE NO. 2002-O-296

 

APPROVING THE DONATION OF AN APPROXIMATE 3.03 ACRE TRACT (SURFACE ONLY) OF NON-AERONAUTICAL USE LAND LOCATED AT THE LAREDO INTERNATIONAL AIRPORT TO THE BOARD OF REGENTS OF THE UNIVERSITY OF TEXAS FOR THE PUBLIC PURPOSE OF ESTABLISHING AND OPERATING AN EXTENSION CAMPUS OF THE UNIVERSITY OF TEXAS HEALTH SCIENCE CENTER AT SAN ANTONIO IN ACCORDANCE WITH SECTION 272.001 (J) OF THE LOCAL GOVERNMENT CODE AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS. THIS CONVEYANCE COMPLETES A DONATION OF APPROXIMATELY 12.003 ACRES WITH A FAIR MARKET VALUE OF  $2,617,000.00

 

            WHEREAS, the City of Laredo has a critical need to improve health education opportunities for its citizens and this need could be addressed by the donation of a tract of land on which to construct, maintain and operate an extension campus of the University of Texas Health Science Center at San Antonio; and

 

            WHEREAS, Section 272.001 (j) of the Local Government Code enables political subdivisions to donate, exchange, convey, sell, or lease land or an interest in real property to an institution of higher education to promote a public purpose related to higher education for less than its fair market value; and

 

            WHEREAS, the Airport Fund is prohibited from disposing of airport property without receiving fair market value compensation; and

           

WHEREAS, the Federal Aviation Administration on October 12, 1999 approved a release enabling the Airport Fund to sell at fair market value the subject tract of land; and

 

            WHEREAS, the City of Laredo General Fund acquired the subject property from the City of Laredo Airport Fund and now proposes to donate the subject 3.03 acre tract of land (surface only) whose appraised fair market value (land only) is $619,980.00; and

 

            WHEREAS, this donation of approximately 3.03 acres completes the intended donation and conveyance of an approximate 12.003 acres to the Board of Regents of the University of Texas, and

 

            WHEREAS, the Mayor and City Council finds that said donation to the Board of Regents of the University of Texas to establish and operate an extension campus of the University of Texas Health Science Center at San Antonio meets the public purpose criteria of Section 272.001 (j) of the Local Government Code.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

 

Section 1:         The City Manager be and is hereby authorized to execute all necessary conveyance documents to execute the donation of the subject property herein described by metes and bounds to the Board of Regents of the University of Texas.

 

A tract of land containing 3.03 Acres, more or less, being out of Block 22, Subdivision plat of Laredo Airport, in the City of Laredo, Webb County, Texas, a Recorded in Volume 5, Webb County Plat Records said 3.03 Acre tract being more particularly described as follows:

 

BEGINNING, at a found 5/8 inch iron rod on the east right-of-way line of Foster Ave. (60’ right-of-way);

 

THENCE, N 48º 03’15” E a distance of 21.19 feet (called N 48º 02’07” E, 21.20’) to a found 5/8 inch iron rod on the south right-of-way line of Pappas St. (60’ right-of-way) a deflection right;

 

THENCE, S 86º 56’34” E along the said south right-of-way line of Pappas St. a distance of 363.09 feet (called 363.03’) to a found 5/8 inch iron rod a deflection right;

 

THENCE, S 41º 23’06” E a distance of 21.04 feet (called S 41º 26’19” E, 21.13’) to a found 5/8 inch iron rod on the west right-of-way line of Bartlett Ave. (right-of-way width varies) a deflection right;

 

THENCE, S 03º 22’50” W a distance of 322.80 feet (called S 03º 10’56” W) to a found ½ inch iron rod on the west right-of-way line of Barltett Ave. (right-of-way width varies) the southeast corner of the herein described tract;

 

THENCE, N 86º 47’12” W a distance of 391.02 feet to a found ½ inch iron rod on the east right-of-way line of Foster Ave., the southwest corner of the herein described tract;

 

THENCE, N 03º 03’48” E (called N 03º 01’12” E) along the east right-of-way line of Foster Ave. a distance of 321.78 feet to the POINT OF BEGINNING of this 3.03 acre tract.

 

The basis of bearings used for this survey is Subdivision Plat of Laredo Airport, in the City of Laredo, Webb County, Texas, as Records in Volume 5, Webb County Plat Records.

 

Section 2:         This Ordinance shall become effective upon passage hereof.
