SUBJECT:   FINAL READING OF ORDINANCE NO. 2003-O-059

Authorizing the City Manager to execute a lease with Gearbuck Aviation

Services for approximately 400 square feet constituting Building No. 124

located at 4603 Maher Avenue-Rear at the Laredo International Airport. 

Lease term is for three (3) years commencing on February 1, 2003 and

ending on January 31, 2006.  However, it is agreed by the parties that the

lease may be terminating by either party upon giving a thirty (30) day

written notice from the party terminating to the other. Monthly rent shall

be $500.00 and will be adjusted annually according to changes in the

Consumer Price Index; providing for an effective date.

PREVIOUS COUNCIL ACTION:   On February 18, 2003, Ordinance was introduced by City Council, and Staff was instructed to proceed.

 

BACKGROUND:         

 

Gearbuck Aviation Services proposes to lease Building No. 124 for use as a base office/storage for their operations.  Gearbuck Aviation Services provides cleaning, polishing, and general maintenance at several airports across the nation and has been asked by several of their customers (Bax Global, ATI) which are involved in air cargo operations to service them at Laredo International Airport.

 

Gearbuck Aviation Services will be required to comply with the airport’s storm water pollution prevention plan as well as coordinate with the City of Laredo-Environmental Engineering Department with respect to compliance issues as they relate to their operations.

 

The building being proposed has never been previously leased and was formally used as a storage room for lawn maintenance equipment.

COMMITTEE RECOMMENDATION:  The Airport Advisory Committee recommends approval.

 

 

 

STAFF RECOMMENDATION:  That the City Manager be authorized to execute a lease with Gearbuck Aviation Services.

 

 

 

 

ORDINANCE NO. 2003-O-059

 

AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE WITH GEARBUCK AVIATION SERVICES FOR APPROXIMATELY 400 SQUARE FEET CONSTITUTING BUILDING NO. 124 LOCATED AT  4603 MAHER AVENUE (REAR) AT THE LAREDO INTERNATIONAL AIRPORT;

1.  LEASE TERM IS FOR THREE (3) YEARS COMMENCING ON FEBRUARY 1, 2003 AND ENDING ON JANUARY 31, 2006.  HOWEVER, IT IS AGREED BY THE PARTIES THAT THE LEASE MAY BE TERMINATED BY EITHER PARTY UPON GIVING A THIRTY (30) DAY WRITTEN NOTICE FROM THE PARTY TERMINATING TO THE OTHER;

2.  MONTHLY RENT SHALL BE $500.00 AND WILL BE ADJUSTED ANNUALLY ACCORDING TO CHANGES IN THE CONSUMER PRICE INDEX; PROVIDING FOR AN EFFECTIVE DATE.

 

 

            WHEREAS, the Airport Director  recommends that the City Council approve the proposed lease between the City of Laredo, as LESSOR, and Gearbuck Aviation Services, as LESSEE, for approximately 400 square feet constituting Building No. 124 located at 4603 Maher Avenue (Rear) at the Laredo International Airport, as a contract and in furtherance of the development of the Laredo International Airport and as a support to the maintenance and operation of the Laredo International Airport;

 

            WHEREAS, the Airport Advisory Committee finds that said lease is in the best interest of the Airport and recommends that the City Council approve the proposed lease; and

 

            WHEREAS, the City Council of the City of Laredo having heard the recommendations of the Airport Director and of the Airport Advisory Committee agrees with same.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAREDO THAT:

 

Section 1:         The City Manager be hereby authorized to execute a lease with Gearbuck Aviation Services for approximately 400 square feet constituting Building No. 124 located at 4603 Maher Avenue (Rear) at the Laredo International Airport, a copy of which lease is attached hereto as Exhibit A, and incorporated herein as if set out at length for all intents and purposes.

 

Section 2:         This Ordinance shall become effective upon passage hereof.
