Final Readings of Ordinance
2001-O-114 An ordinance authorizing the City Manager to execute a lease with
Laredo
Independent School District for approximately 5.75
acres located on Block No. 19 of the Laredo Airport Subdivision Plat at the
Laredo International Airport. Lease
term is for thirty (30) months commencing on June 1, 2001 and ending on October
31, 2003. Monthly rent shall be
$4,383.26; providing for an effective date.
Mayor Flores read the ordinance publicly into the
record.
Larry Dovalina, City Manager, stated that a meeting
was held last Tuesday with several individuals from the school district,
including Mr. John Peter Montalvo. Mr.
Dovalina indicated to them some concerns that the City has in regards to safety
of the school children. The school
district has agreed to address these concerns and to include the City’s
provisions as part of the approval of the lease. Mr. Dovalina read the lease provisions into the record:
1. If traffic congestion develops in the area
of the leased premises, Lessee shall hire the necessary number of off-duty police
officers to control the flow of traffic;
2. Lessee shall construct at its sole cost an
eight foot (8’) chain link fence along the perimeter of the leased premises to
ensure a closed campus and
Lessee will not be allowed to ingress or
egress on Pappas and Daugherty Streets within one hundred fifty (150’) feet
from the intersection of Daugherty and Pappas;
3. All costs associated with traffic related
issues and all other costs incidental to the operation of a school campus,
whether on-site or off-site, shall be borne by Lessee;
4. Approval of this Lease is granted contingent
upon that the subject premises receive a favorable recommendation from the
Planning and Zoning Commission for an appropriate zone change as well as from
City Council;
5. Lessee shall cause its demolition and site
grading contractors to dispose of all debris and materials to be disposed of at
the City’s Landfill. Lessee shall
provide Lessor with copy of landfill tickets; and
6. Lessee shall not cut down the palm trees
located on the leased premises and Lessee shall maintain the palm trees in a
neat and trim condition;
7. Failure by Lessee to satisfactorily address
and correct such issues that may be of concern to Lessor shall constitute a
breach of this Lease.
John Peter Montalvo,
L.I.S.D. Board of Trustees member, stated that they are in dire need of this
area and due to the time constraints they need it now. He asked City Council to approve and execute
this lease agreement.

agreement with a 30-month lease term instead of 24 months.
