10. Public hearing and introduction of an ordinance altering and extending the boundary

limits of the City of Laredo, annexing additional territory of 30.00 acres, more or less,

located immediately east of Bob Bullock Loop and south of San Isidro Northeast,

specifically the Daughters of Mary Help Tract, providing for the effective date of the

ordinance, authorizing the City Manager to execute a contract adopting a service plan

for the annexed territory, and establishing the initial zoning of R-1 (Single Family

Keith Selman, Planning and Zoning Director, reported that these are voluntary annexations and are subject to an agreement. He stated that the in the absence of the signing of those agreements, Council will be made aware that the agreements have not been signed; therefore, the Final Readings would not occur.

VIII. INTRODUCTORY ORDINANCE

11. Approving and authorizing the City Manager to:

1. Execute an easement to the Department of Homeland Security for a term of 25 years for construction of a Riverbend Roadway with option to extend the term; and

2. Execute a Temporary Construction Easement to the Department for a term of two (2) years; and providing for an effective date.

Dr. Jim Earhart spoke against the easement for the construction of a river road.

Marcos Garcia, Border Patrol Assistant Chief, stated that they are requesting an

easement to construct 1.13 miles of an all-weather road. He added that all environmental compliances have been met.

Arturo Garcia from Community Development reported that there are three amendments to this ordinance one of which is to the easement. He read the following “ Provided further, that the Grantor does hereby waive, release and discharge the Grantee, its officers, agents and employees, form all claims for restoration to the property upon termination of this easement; and provide further, that the Grantee may request of Grantor, an extension of this easement for an additional period or periods, each of five (5) years, by written request given at least three months prior to the end of the current easement term, and any such extension can only by granted by the City Council of the City of Laredo.” He stated that the second amendment would be to the temporary working easement which is for 24 months and noted that the amendment is only to the exhibit labels. He mentioned that tract 1 will have an Exhibit A and Exhibit B; tract 2 will have Exhibit C and Exhibit D; and Tract 3 will have Exhibit C and Exhibit D. He reported that the third amendment is to the actual ordinance which would increase the actual acreage amount from 3.7 to 4.94 acres. Finally, Mr. Garcia read the last amendment as follows: “Whereas, for this purpose the Department of Homeland Security needs a 25 year easement over the 4.94 acre parcel of city land, which easement is described in Exhibit 1 and needs a 2 year temporary construction easement abutting each side of the 4.94 acre easement, and also for two staging areas of 0.06 acre, and

0.84 acre of city land, which temporary construction easement is described in Exhibit 2, and these in order to construct the roadway described.”
